Finance & Taxation ComplianceThe Excise Department, Delhi, on May 30, 2024, issued advisory for restaurants and eateries.

Rule 51(10)(h) of the Delhi Excise Rules, 2010, requires a No Objection Certificate (NOC) from the fire department for retail licenses for on-premises consumption. Currently, the fire department issues NOCs only to restaurants/eateries with an area of 90 square meters or more. The Excise department requires an affidavit regarding fire safety compliance from establishments smaller than 90 square meters.

Due to the severe heat waves and multiple fire incidents, the Delhi Fire Service Department clarified in its letter dated April 9, 2019, that restaurants with an area of 90 square meters or more must submit sanctioned plans detailing fire safety arrangements through local authorities (MCD, NDMC, DDA, etc.).

All existing licensees with a gross floor area of 90 square meters or more must renew their Fire NOC before expiry and adhere to fire safety norms. Restaurants/eateries with an area less than 90 square meters must take all necessary fire safety precautions to prevent incidents. Failure to comply may result in action under the Delhi Excise Act, 2009, and Rules 2010, including license suspension or cancellation.
